一、關(guān)于國有企業(yè)下屬參股子公司能否參與該國有企業(yè)組織的招標(biāo)的答復(fù)

國有企業(yè)下屬參股子公司能否作為投標(biāo)人公平參與國有企業(yè)組織的招投標(biāo)工作？

答復(fù)：《招標(biāo)投標(biāo)法實(shí)施條例》第三十四條第一款規(guī)定，與招標(biāo)人存在利害關(guān)系可能影響招標(biāo)公正性的法人、其他組織或者個(gè)人，不得參加投標(biāo)。本條沒有一概禁止與招標(biāo)人存在利害關(guān)系法人、其他組織或者個(gè)人參與投標(biāo)，構(gòu)成本條第一款規(guī)定情形需要同時(shí)滿足“存在利害關(guān)系”和“可能影響招標(biāo)公正性”兩個(gè)條件。即使投標(biāo)人與招標(biāo)人存在某種“利害關(guān)系”，但如果招投標(biāo)活動(dòng)依法進(jìn)行、程序規(guī)范，該“利害關(guān)系”并不影響其公正性的，就可以參加投標(biāo)。（答復(fù)單位：發(fā)改委法規(guī)司）

二、招標(biāo)人隸屬于母公司一級(jí)子公司（科研單位），投標(biāo)人屬于母公司另一級(jí)子公司（建筑單位）的二級(jí)子公司，投標(biāo)是否屬于串標(biāo)行為？

答復(fù)：在招標(biāo)人與投標(biāo)人屬于一家公司控股的情況下，并未禁止投標(biāo)人參與投標(biāo)，但依據(jù)《中華人民共和國招標(biāo)投標(biāo)法實(shí)施條例》第三十四條第一款的規(guī)定，如果投標(biāo)人與招標(biāo)人存在利害關(guān)系可能影響招標(biāo)公正性的，則不得參加投標(biāo)。招標(biāo)人與投標(biāo)人是否構(gòu)成串通投標(biāo)，需要依具體行為進(jìn)行認(rèn)定。（答復(fù)單位：住建部）

三、現(xiàn)一采購人采購一項(xiàng)目，底下有一家公司為采購人全資管理控股的子公司，想請(qǐng)教：該子公司能否參與該項(xiàng)目投標(biāo)，有無相應(yīng)法律依據(jù)是可以還是不可以？

答：政府采購法律制度未對(duì)采購人全資管理控股子公司參與其采購項(xiàng)目做出限制性規(guī)定。（答復(fù)單位：財(cái)政部國庫司）

四、同一母（總）公司的多家全資控股或絕對(duì)控股子公司，各子公司的單位負(fù)責(zé)人不是同一人，他們之間也不存在直接控股或管理關(guān)系的。這樣的情況下，各子公司同時(shí)參與同一合同下的政府采購活動(dòng)是否違反現(xiàn)行的法規(guī)要求？

答：根據(jù)政府采購法實(shí)施條例第十八條規(guī)定，如果參與投標(biāo)的子公司間不存在相互控股、管理關(guān)系或者負(fù)責(zé)人為同一人的，則不違反規(guī)定。（答復(fù)單位：財(cái)政部國庫司）
